Activating Non-Statutory Leave after Statutory Leave is used

We have 2 leave types, statutory and non-statutory. Through the Request Absence feature in IFS, the employees can select only the leave type statutory. So that works fine. Type non statutory is turned off as shown below. How can we automatically activate for selection on the absence request once all the statutory leaves are used? [I know manual activation is possible through edit in the screen]
